Ring-Around-The-Rosie Lawsuits:
Well, well, well. If it isn't the Justice Department playing legal ring-around-the-rosie with two state governments, Michigan and Hawaii. In frosty town Michigan and sun-soaked Hawaii, they've got a beef with Big Oil, blaming the industry's little habit of belching out greenhouse gases for some rather inconvenient climate catastrophes. But the Justice Department isn't having it, declaring "You can't sue them! That's our job!"
Ain't No Party Like a Litigation Party:
So, here's the kerfuffle: The Justice Department, in all its glory, has hurled lawsuits against Michigan and Hawaii for daring to glare menacingly at fossil fuel companies. It claims that these state-led legal tussles are trespassing on federal territory, specifically, Trump's 'energy dominance' goals. The filings tell us that the Clean Air Act - the EPA's pride and joy - muzzles the rights of individual states to regulate greenhouse emissions crossing their borders. So, according the feds, the global debacle of climate change is merely a national issue. How droll!
The Justice Department tag-teamed its litigation spree with echoing Trump's cries of an energy crisis in the country? Its filings bewailed how Michigan and Hawaii were "standing in the way" of securing domestic energy sources rather than helping in the alleged crisis.
In Green We Trust:
Legal mavens, however, are cocking their brows at these oddball lawsuits. Michael Gerrard, a distinguished Ivy Leaguer who heads the Columbia University Sabin Center for Climate Change Law, dubs them "highly unusual" and describes them as intimidation tactics to help Big Oil sleep better at night. In his words, "it's telling the fossil fuel companies how much Trump loves them." Climate litigation consultant Ann Carlson also called out the hypocrisy of the Justice Department's moves. It's like they're excitedly hopping between claiming greenhouse gas regulation is their exclusive playground, while simultaneously attempting to veto the Clean Air Act's authority over such regulation. With this clumsy dance between states' rights over environmental action and the US government's explicit investment in fossil fuel, a legal tug-of-war is in full swing.
Trump’s Fossil Fuel Fiesta:
The current federal administration is on a passionate mission to roll out the red carpet for fossil fuel industries. Aggressively unrolling established climate policies and regulations, it's all coal, oil, gas, the blockbuster trio. Who cares about air and water regulations, or renewable energy sources?
